whereas THE OPEN GROUP invests significant amounts of time and money in the development and management of its audit documents and carefully protects their integrity and confidentiality; 2. That the exam questions and answers are the exclusive and confidential property of THE OPEN GROUP and are protected by the intellectual property rights of THE OPEN GROUP; 3. That you may not disclose the exam questions or answers or discuss the content of the exam material with any person without the prior written permission of THE OPEN GROUP; 4. That you will not remove from the examination room any examination material of any kind provided to you or any other material related to the examination, including but not limited to marks or calculations; 5. That you will not copy or attempt to make copies (written, photocopied or otherwise) of the Examination Material, including but not limited to Examination Questions or Answers; 6. That you will not sell, license, distribute, give or obtain any other OPEN GROUP exam materials, questions or answers. Certiport collects personal data when you register for an exam. Please read our policy to learn more about the privacy of this information and how your information may be used by Certiport and its partners. This Agreement shall be governed by and construed in accordance with the laws of the State of Minnesota, United States of America, and the applicant further consents to the jurisdiction of the state and federal courts located in Hennepin County, Minnesota. By accepting this Agreement, you agree that the following terms govern your participation in the Certification Program (ISC)² and the Test Administration (”Program”). The ”Effective Date” of this Agreement is the date of your acceptance of this Agreement. If you do not agree or cannot accept the terms and conditions contained herein, do not accept these terms and do not proceed with the examination and certification process.

If you do not agree to be bound by this Agreement, you will be asked to exit the exam before the exam can begin. You will not receive any certification and will not be able to use a test mark. Since these terms and conditions were submitted to you at the time of scheduling the exam and the decision to proceed was made by you, your application for an exam fee will NOT be refunded. The content of Certiport exams is confidential and protected by trade secret law and other applicable laws. It will be made available to you, as a candidate, solely for the purpose of measuring competence in relation to the exam(s) taken. The Candidate is expressly prohibited from disclosing, publishing, reproducing, summarizing, paraphrasing or transmitting these Exams, in whole or in part, in any form or by any means, orally or in writing, electronically or mechanically, for any purpose whatsoever, without the express prior written permission of Certiport, an NCS Pearson company, Inc. If a candidate violates any rule, guideline, or exam determination under the Exam Security Agreement (NDA), or engages in misconduct that in any way reduces the security and integrity of the Open Group certification program, the candidate may be permanently barred from taking future exams. In addition, the candidate may be decertified from the Open Group certification program, including removal from certification records, and test results and certifications may be revoked.
